Criminal Tariff changes

The Legal Services Society (LSS) is implementing changes to the Criminal Tariff effective May 7, 2018. The changes are:

  • a new fee for sentencing in a recognized First Nations Court, and
  • a new tariff item for Gladue submissions.

The updated Criminal chapter of the LSS Tariffs will be available on May 7, 2018, on the LSS website at legalaid.bc.ca (under Lawyers — LSS Tariffs) and in LSS Online under Resources.

Transition rules for contracts

The First Nations Court sentencing fee will be added to all new criminal contracts and existing criminal contracts that have not yet reached their service stop date. You can bill this fee for sentencing that occurs on or after May 7, 2018.

The new Gladue fee tariff item will be added to all new criminal contracts and existing criminal contracts that have not yet reached their service stop date. You can bill this item for services provided before or after May 7, 2018.

Your existing contracts, that have not yet reached their service stop date, will be updated in LSS Online with the applicable changes.
