Criminal law: Applying on behalf of your clients

Due to COVID-19, LABC has a new, temporary process that allows lawyers to apply for legal aid on behalf of in-custody and out-of-custody Criminal law clients who, due to barriers or other challenges, are unable to contact us themselves.

These procedures are not meant to replace the regular application process through the Call Centre at 604-408-2172 (1-866-577-2525 toll-free) or local agent offices for clients who are able to apply for themselves.

In-custody clients

  • The application form only applies to in-custody clients, and may be used by in-custody duty counsel and representation lawyers;
  • The Legal Aid Representation Services form must be read and explained to clients. They must verbally agree to comply with the contract rules;
  • You may fill out the application form on behalf of the client. Fields with an asterisk are mandatory;
  • Email the completed application form to onlineapplications@​lss.​bc.​ca or fax it to 604-681-2719 for processing.

Out-of-custody clients

  • Clients should contact the Call Centre or the local agent in their community to apply for legal aid;
  • If you have a new client who has an urgent issue that is covered by legal aid, is financially eligible, and is unable to apply for legal aid, you may take any steps necessary to protect the client’s interests and have the client make the application later. The contract will be backdated so that you can bill for services provided;
  • If you acted for the client, but are now unable to reach the client, another option is to contact our Intake Reciprocals/​Training Coordinator directly at onlineapplications@​lss.​bc.​ca for either a short-term contract or Criminal Early Resolution Contract. This option is available on a case-by-case basis only.
